Thank you for choosing CPAP Store New York. We understand the importance of your purchase and are committed to ensuring a transparent and compliant experience aligned with 2025 state and federal health regulations.

All Sales Are Final

Due to the medical nature of our products and in full compliance with FDA, CDC, Nevada, and New York State health laws, all sales are final on respiratory-related items, including:

  • CPAP & BiPAP machines
  • Oxygen concentrators
  • CPAP/BiPAP masks, cushions & headgear
  • Tubing, nasal pillows, filters & accessories

Opened or used products cannot be returned or resold due to infection control and hygiene protocols.

Regulatory Compliance

  • FDA 21 CFR Part 820: Disallows resale of opened medical devices
  • CDC Guidelines: Enforces infection control in respiratory equipment
  • Nevada Revised Statutes (NRS 629): Governs patient safety & medical use
  • New York Public Health Law § 3302: Covers medical device safety practices

Unopened Items

Returns are only accepted for completely unopened, unused, factory-sealed products. Items with broken seals, damaged packaging, or any signs of use will not be accepted.

If you are unsure about your purchase, please contact us before opening the box. We may offer store credit or a discount on future purchases at our discretion.

Manufacturer Defects Only

For manufacturer defects, we can guide you through the warranty process. If approved, a Return Merchandise Authorization (RMA) will be issued:

  • No returns accepted without a valid RMA
  • Return shipping is the customer’s responsibility unless otherwise stated by the manufacturer

Return Conditions

  • Request must be made within 7 calendar days of delivery
  • Item must be unopened, unused, and in original sealed packaging
  • Sale or discounted items are non-returnable
  • Shipping fees are non-refundable and will be deducted from any eligible refund

Unauthorized Returns

Items returned without written authorization or valid RMA may be refused, discarded, or returned at your expense. This includes:

  • Opened, used, or repackaged items
  • Returns submitted without approval

Deliberate return fraud may result in legal action under Nevada law:

  • NRS 205.380 – Fraudulent return or false pretenses
  • NRS 205.0832 – Theft by deception

Refused or Returned Shipments

  • We are not responsible for shipments lost/damaged in transit
  • Packages returned for incorrect address may be subject to reshipping fees
  • International refusals/unclaimed packages will incur a 35% restocking fee + shipping

Order Verification & Fraud Prevention

To protect against fraud, we may verify orders where billing and shipping information does not match. We may request a government-issued ID. Suspicious orders may be held or cancelled.
